WHAT ARE THE EMPLOYER’S OBLIGATIONS?

In terms of Regulation 3 of the Asbestos Abatement Regulations of 2020, every employer is obliged to have the workplace inspected by a competent person for the presence of asbestos. If asbestos containing materials are identified, the competent person must compile the prescribed reports, including an inventory of asbestos in place, a risk assessment, a risk of exposure assessment and asbestos management plan and warning signs must be erected.

WHY IS IT NECESSARY?

Asbestos is internationally classified as a carcinogen. Exposure to asbestos fibers or dust is dangerous. If asbestos is breathed in or ingested it can lead to malignant diseases such as asbestosis, mesothelioma, various cancers and eventual death. Failure to comply with the Regulations could also lead to prosecution, fines and/or imprisonment.

WHERE IS ASBESTOS FOUND?

Asbestos was used in the manufacture of a multitude of building materials, including roof sheets, wall sheets, ceiling boards, gutters and downpipes, backboards windowsills, pipe insultation, water pipes and tanks, floor tyles and many more.

WHAT ABOUT LEASED PREMISES?

In terms of section 67 and Regulation 36 of the Property Practitioners Act of 2020 and Regulations, the owner/landlord and property consultant are obliged to disclose any “defect”, including the presence of asbestos in any property to any prospective tenant or purchaser. Failure to do the compulsory disclosure on the prescribed form can lead to their personal liability. It, however, remains the responsibility of the employer to ensure that the workplace is safe and will not negatively impact the health and welfare of the workers and other persons entering the premises.

WHAT CAN BE DONE ABOUT ASBESTOS?

If in a reasonable condition that does not require prior surface preparation, asbestos containing materials can be repaired (sealed or painted) and/or removed and replaced with modern building materials.
